What is Confidentiality and privacy rights.

In regards to the adolescent health, the term confidentiality refers to the obligation of healthcare providers, counsellors, teachers, or other professionals to keep personal information shared by adolescents private and not disclose it without their consent. This pertains to adolescents’ right to control access to their personal information and physical space, ensuring they can develop independence and self-identity.

Confidentiality and privacy are essential in adolescent health because dadolescents are in a developmental stage where they seek autonomy. They may face sensitive issues such as sexual health, mental health, substance use, or family problems. Hence, respecting confidentiality encourages them to seek healthcare, counselling, or support services without fear of judgment or disclosure.

Why is Confidentiality and privacy rights an issue among adolescents.

In many countries, less than 20% of adolescents with mental health conditions receive the care they need. Adolescents from low-income families are less likely to access essential health services. In low- and middle-income countries, up to 70% of adolescents do not receive necessary health interventions due to economic and infrastructural barriers (UNICEF, 2019). A significant gap exists in the availability of youth-friendly health services. Only about 50% of countries have policies or programs designed to provide adolescent-friendly health services (WHO, 2020). Confidentiality and privacy is essential to creating friendly environment because:

  1. Adolescents might fear embarrassment or social stigma if their private information is disclosed.
  2. The Healthcare providers sometimes face conflicts between legal obligations (e.g., mandatory reporting) and respecting adolescents’ confidentiality. The balance between the legal requirement and adolescent’s privacy/confidentiality is essential in creating friendly environment for the adolescents to access health and other services.
  3. Adolescents may wish to keep certain issues private from their families, especially in cases of abuse, mental health concerns, or sexual activity. Hence, creating environment where they can open up about these issues are central to creating adolescent friendly service environment.
  4. Concerns about confidentiality can prevent adolescents from seeking necessary health services, particularly for sensitive issues like sexual health or mental health. They only want to access services where they are guaranteed of confidentiality and privacy.
  5. Determining how much privacy adolescents deserve while involving parents or guardians can be challenging. Hence, health workers need to be capacitated on adolescent friendly approach to service delivery.

How Confidentiality and privacy rights of adolescents can be promoted

It essential that parents, guidance, health service providers and educational institutions create environment and mechanisms that upholds the adolescent’s privacy and confidentiality. The following are some of the practical steps to uphold adolescents’ confidentiality and privacy:

  2. We need to educate healthcare providers, teachers, and counsellors on adolescents’ rights and how to handle sensitive information ethically.
  3. Enforce laws that recognize adolescents’ rights to confidentiality, especially regarding sexual and reproductive health.
  4. : Ensure healthcare facilities, schools, and community centres are private and confidential spaces for adolescents to open up and freely share their health issues and needs.
  5. Parents and institutions should be intentional to involve adolescents in decisions about their privacy and educate them on their rights.
  6. You should always obtain consent from adolescents for sharing information with parents or guardians, respecting their maturity level.
  7. Service providers can utilize private conversations and secure record-keeping methods to protect information.
